Council wins planning enforcement appeal

Havant Borough Council has won a breach of planning control appeal in the case of an unauthorised business operating from a domestic property.

In the decision by the Secretary of State, planning inspector it was concluded that the enforcement notice issued by Havant Borough Council is upheld, and that the appeal, brought by the owner of the property in Portsdown Hill Road, Bedhampton, Havant, was dismissed.

The owner, who appealed against the council’s enforcement action, under section 174 of the Town and Country Planning Act 1990, is now required to remove all motor vehicles, together with equipment associated with a motor vehicle repair business, to remove the hard-surfaced area engineered for the purposes of parking cars and to restore the land to its condition prior to the breach of planning control taking place.

“It is good to see that the inspector has also supported the council’s approach to protect our community from unauthorised development.”

The owner has until 26 October to undertake the work.
