Under Regulation 123 of the CIL Regulations, the council is expected to publish a list of infrastructure that will benefit from CIL funds.
The purpose of the List is to differentiate between those types of infrastructure that the authority intends to fund through CIL, and those areas where a ‘Section 106’ planning obligation or ‘Section 278’ highway agreement will be sought to make the development acceptable in planning terms. The authority cannot ‘double charge’ a development.
The list was approved by Council on 24 July 2013 along with the following recommendation from cabinet that CIL monies collected from 1 August 2013 to April 2014 should not be spent until the council have agreed the spending priorities, spending proportions and the appropriate decision making body for spending. At Council on 18 February 2015 it was agreed that explanatory notes should be added to the original Regulation 123 List to make it's purpose clearer.
