Pollution Control - Clean Air Act Chimney Height Approval
When new industrial heating or boiler
plant is to be installed, it may in some circumstances be necessary
to obtain authorisation for the height of the chimney to be used in
conjuction with the appliance. Please apply to the Council for
authorisation before installing the associated heating or boiler
plant.

The purpose of Chimney Height Authorisation
To protect against high concentrations of air
pollutants at ground level, which could create health effects, the
Clean Air Act 1993, introduced a wide range of new regulations such
as those which control smoke emissions and the height of chimneys
and those relating to the content and composition of motor
fuels.
The control of chimney heights enables local
authorities to take into account a number of relevant factors in
determining the height of a chimney. The theory behind this is to
ensure that emissions from chimneys exit at high levels to aid
dispersion and dilution and limit the process of gravity from
bringing high concentrations of grit, dust, soot and gases down to
ground level.
Offences
The Clean Air Act 1993 makes it an offence to cause or
knowingly permit a furnace to be used to:
- burn pulverised fuel, or
- burn any solid matter at a rate of 45.4 kg or more an
hour, or
- burn any liquid or gaseous matter at a rate equivalent to 366.4
kW or more,
unless the height of the chimney has been approved by the
Council and any conditions attached to approval adhered to.
How to apply for Authorisation of a Chimney Height
In order to apply for a chimney height approval you must
complete and application form and submit this to the Council's
Environmental Protection Team. The application for chimney height
approval must contain adequate information to enable the necessary
calculations to be carried out. Please contact the
Environmental Health Team if you need to submit an
application.
Approval of Application
The Council will give a written decision on the application
within 28 days of it's receipt, unless it is agreed in writing
between us and the applicant that a longer period is allowed. If we
fail to deal with the application within this time period, then
approval, without qualification or condition, is automatically
given.
