Regularisation Certificates
Where 'regularisation' is required for unauthorised building
work, carried out after 11th November 1985, an
application may be made to the Local Authority for a regularisation
certificate.
The following should be submitted with the completed
application form:
- A description of the unauthorised work
- Plans of the unauthorised work
- Plans showing additional work to be carried out to ensure
compliance with the Regulations in force at the time the work was
carried out
- The correct fee (based on 120% of the equivalent Building
Notice Fee, excluding VAT).
Upon receipt of your application, the Local Authority will
issue an acknowledgement letter requesting that you notify the
Building Control Section (giving 2 days notice in writing), when a
site visit can be made to inspect the works. Following this
site visit, the Building Control Officer may write requiring
additional information or issue a schedule of works to be opened up
for inspection. A list of any additional works that are
required to ensure compliance with the Regulations (in force at the
time of the original works), will also be set out.
The Council is under no obligation to issue a 'Regularisation
Certificate', but if the final works appear satisfactory they may
issue a Certificate. There is no right of appeal (or refund
of fees) should this certificate be refused.
An application for regularisation will not prejudice the
Council's statutory power under section 36 of the Building Act 1984
in respect of any enforcement action.
