Contaminated Land : Powers to Ensure Affected Sites are
Remediated
The council may exercise powers under Part IIA of the 1990 Act
to require the clean-up of land contamination, if the risks are
deemed sufficiently high to justify action (accounting for the
SPT linkage, see 'Introduction to the Strategy for
Identifying & Prioritising Contaminated Sites'). In order to
ensure 'best value' however, this type of action will be reserved
for only the highest priority sites.
Once sufficient information has been gathered in order to
determine a site poses a high risk, clean-up can be achieved by
serving a notice on the 'appropriate person' (as defined under Part
IIA) for additional assessment, and/or site remediation works to be
completed to a standard suitable for the current landuse. Failure
to comply with a remediation notice is an offence under the 1990
Act.
