APPENDIX D
Advice Note To Standards Committee Hearing Grievances Against
Members of the Council
If a Grievance against a Member
is upheld, then the Committee should consider making the following
recommendations to the appropriate Group Leader (or, in the case of
a Member not within a political group on the Council, the Managing
Director):
- In all cases the aggrieved should receive a suitable written
note of apology.
- The Group Leader (or Managing Director if the Member is not
within a political group on the Council) should issue a written
statement to the Member that their behaviour has been adjudged as
unacceptable by a cross-party panel of their peers and should not
be repeated.
- The Committee should require that the Group Leader (or Managing
Director if the Member is not within a political group on the
Council) takes steps to ensure that the aggrieved is able to
continue working normally.
- In severe cases, and subject to the approval of the relevant
body or full Council, the Member may be relieved of special duties
such as Chairperson, Membership of Working Party, representation on
outside organisations, or even membership of the relevant
body.
- The key issue is that the action causing the grievance must
cease. Exceptionally, management may agree to transferring an
affected employee to other duties, providing that this is agreeable
to the individual employee and not detrimental to the work of the
organisation.
The Group Leader (or Managing
Director if the Member is not within a political group on the
Council) should remind the Member that, notwithstanding the action
taken, individuals may have a right to pursue the matter through
the relevant legal channels.
